En octubre pasado algunos representantes de la comunidad LGBT presentaron a la Asamblea Legislativa del Distrito Federal un proyecto para reformar diversas disposiciones del Código Civil y del Código de Procedimientos Civiles con el fin de instaurar el matrimonio entre personas del mismo sexo. 

Dado que en el DF ya existen las sociedades de convivencia, que reconocen contratos de unión y responsabilidad entre personas del mismo sexo, ¿por qué entonces exigir la figura de matrimonio civil? 

Hace años, cuando la demanda cobró actualidad política en Europa, la revista británica The Economist señaló el quid del asunto: se trata de una exigencia de igualdad ciudadana (6 de enero, 1996). Sí, en el fondo la cuestión es el reconocimiento de lesbianas y homosexuales como ciudadanos con iguales derechos que las personas heterosexuales, incluyendo el derecho de formar una familia. 

¿Por qué se oponen los conservadores? Porque no es “natural”, porque va contra el dogma católico y porque, como expresó el diputado Eguren Cornejo, del PAN, “¿qué garantía de vida normal podemos dar a una persona cuando dos personas del mismo sexo lo quieren adoptar, si hoy en día tenemos problemas de familias disfuncionales aun siendo heterosexuales?” (La Jornada, 11 de noviembre). 

La lógica no es el fuerte del diputado. Así como la heterosexualidad en sí misma no es garantía de funcionalidad familiar, de igual manera la homosexualidad tampoco es garantía de disfuncionalidad. 

Psicoanalistas con una práctica clínica con familias homoparentales descartan que el supuesto daño psicológico que las criaturas podrían sufrir si se crían en ese tipo de hogar sea mayor que el que podrían padecer en una familia de padres heterosexuales. 

Además, pensar que la orientación sexualpaterna y materna garantiza la salud mental es, precisamente, desdeñar muy convenientemente el hecho innegable de que las familias con padres y madres heterosexuales han estado produciendo de manera sostenida psicóticos, criminales y personas con todo tipo de trastornos de la conducta.

La comunidad LGBT exige igualdad ciudadana, y con ella el derecho a formar una familia, con hijos propios (con reproducción asistida) o adoptados. En el debate sobre la posibilidad de que lesbianas y gays adopten hijos vale la pena recordar el escándalo que se dio anteriormente en relación a las familias monoparentales, las recompuestas y las “artificiales” (a partir de las nuevas tecnologías reproductivas). 

También entonces los conservadores pusieron el grito en el cielo y lanzaron sombrías predicciones sobre los efectos negativos que iban a tener dichos arreglos familiares en las inocentes criaturas. Hoy, pese a tan tétricos augurios, estas familias han demostrando que de madres solas o de padres divorciados no necesariamente resultan personas delincuentes o anormales.

Las posiciones conservadoras se aferran a una creencia sobre lo “anti-natural” de lahomosexualidad y olvidan que justamente la antropología y la historia han comprobado la “naturalidad” de las prácticas homosexuales en todas las sociedades a lo largo de la historia. 

También ignoran los planteamientos psicoanalíticos sobre la bisexualidad innata de la libido. Pero, sobre todo, desconocen que en una democracia laica y pluralista (como intenta ser la mexicana) no es válido fijar un imperativo ético único a partir de creencias religiosas que postulan un supuesto orden “natural”. 

El matrimonio civil de personas del mismo sexo no vulnera los derechos de terceros. Es probable que quienes siguen concibiendo a lesbianas y gays como personas degeneradas o enfermas se nieguen a aceptarlo. Pero asociar la homosexualidad a patología o depravación es ignorancia, fanatismo o mala fe. 

Un ejemplo de las aberraciones discursivas de la derecha para oponerse al justo reclamo de lesbianas y homosexuales de ser tratados igualitariamente es la frase que soltó el diputado Eguren Cornejo, del PAN: “¿Queremos convertir al DF en la jaula de las locas?”. No, diputado, queremos que siga siendo la ciudad más avanzada del país en materia de derechos humanos. 

El exabrupto homofóbico del panista es un indicador de la resistencia que habrá en la Asamblea. Habrá que trabajar para que la sociedad escuche una postura informada científicamente sobre la cuestión. ¿Preocupa el desarrollo psíquico de las criaturas en familias homoparentales? Que se difunda el estado de la investigación sobre el tema, que se hagan foros con especialistas, que se consulte con España, Canadá, Suecia o algún otro de los países que ya han borrado la referencia al sexo en los contratos matrimoniales, lo cual permite que se casen personas del mismo sexo. 

El tema del matrimonio gay es el de la igualdad ciudadana. Se equivoca el panista cuando dice que “el PRD busca destruir a la familia como institución básica de la sociedad”. 

Al contrario, al ser congruente con una ética pública laica y una política antidiscriminatoria, el PRD defiende la postura consistente en que todos los ciudadanos, independientemente de su orientación sexual, tienen el mismo derecho a constituir una familia. Así, el PRD ensancha el sentido exclusivista de la familia tradicional. Veremos hasta dónde dicha ampliación es comprendida por los otros partidos en la ALDF.
